RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-00610 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, be corrected: a. to reflect his service number (Administratively corrected). b. to reflect his service in Korea. APPLICANT CONTENDS THAT: His DD Form 214 do not reflect his correct service number which should end with “56” verses “57” and his numerous Temporary Duties to Korea. In support of his request, the applicant submits a copy of his DD Form 214 with his service number ending in “57”, DD Form 4, Enlistment Contract – Armed Forces of the United States, dated 27 Feb 69, with his service number ending in “56”, DD Form 4, Enlistment Contract – Armed Forces of the United States, dated 18 Mar 69, with his service number ending in “56”, Special Order AD-3506, dated 30 Jul 69 with his service number ending in “56” and AF Form 7, Airman Military Record, with his service number ending in “56”. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 18 Mar 69. On 8 Jan 73, the applicant was furnished an Honorable discharge, and was credited with 3 years, 9 months, and 21 days of active service. His type of transfer or discharge Release from Active Duty and Reenlistment Code 1. On 23 Apr 14, AFPC/DPSIRP notified the applicant that a review of his record revealed several source documents that confirmed the service number on his DD Form 214 was incorrect. On 9 May 14, a DD Form 214/215 Action Order was accomplished for AFPC/DPSOR to correct the applicant’s DD Form 214. This will be accomplished upon conclusion of the Board’s decision. The remaining relevant facts pertaining to this application are contained in the memorandums prepared by the Air Force office of primary responsibility (OPR), which are attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPAPP recommends denial indicating there is no evidence of an error or an injustice. A review of the applicant’s Master Personnel Record and documentation provided failed to provide any substantive Foreign Service time in Korea. A complete copy of the AFPC/DPAPP evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 19 Sep 14 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice warranting correction of the applicant’s records to reflect his service in Korea. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. We note the Air Force OPR has determined the applicant’s service number is incorrect and will correct his records administratively. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
